Terms of Service Agreement

Welcome to Eventnoire (“Eventnoire,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, mobile application, and other services (collectively, the “Platform”). By using or accessing the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

Overview

Eventnoire is an event discovery, ticketing, and registration platform that enables event organizers (“Organizers”) to promote events and sell tickets to attendees (“Consumers”). We provide the technology and support services, but we do not produce or manage any events listed on the Platform.

Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use Eventnoire independently. If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

Payment Processing

All payments made on Eventnoire are processed through Stripe, a third-party payment processor. By using the Platform, you agree to comply with Stripe’s terms of service, privacy policy, and all applicable financial regulations.

Eventnoire does not store credit card or bank account information.

Organizer Responsibilities

If you are an Organizer, you are solely responsible for:

  • Managing ticket sales, refunds, and event communications.
  • Complying with all applicable local, state, and federal tax laws.
  • Handling any disputes or chargebacks directly with Stripe.
  • Ensuring compliance with all relevant legal, safety, and venue regulations.

Eventnoire is not responsible for the delivery, quality, legality, or safety of any events listed on the Platform.

Chargebacks and Disputes
For any Event Organizer who fails to connect their own Stripe account, Eventnoire will serve as the payment processor of record. Organizer acknowledges that Stripe charges a $15 dispute fee for each chargeback initiated by a customer.  To contest a chargeback and the dispute is not resolved in the Organizer’s favor, Stripe charges an additional $15 counter-dispute fee (for a total of $30). If the Organizer prevails in a contested dispute, the counter-dispute fee is refunded by Stripe; however, the initial $15 dispute fee remains non-refundable.

To cover administrative time related to evidence preparation and dispute management, Eventnoire will assess an additional $10 dispute handling fee per case. Organizer authorizes Eventnoire to deduct such fees and disputed amounts from Organizer’s balance, or to invoice the Organizer directly if sufficient funds are not available.

Fees

Eventnoire charges a service fee and Stripe charges a payment processing fee for each ticket sold. These fees are not included in this document and are maintained separately on our FAQ and Pricing Page. Fees may vary by ticket type, location, or event.

Account Termination

Eventnoire reserves the right to suspend, restrict, or terminate any account at its discretion, including but not limited to:

  • Fraudulent activity
  • Violation of these Terms
  • Failure to comply with applicable laws
  • Disputes or excessive chargebacks

Termination may occur with or without notice.

User Content

You are solely responsible for any content (text, images, video, event listings, communications, etc.) you submit or share on the Platform. You must not post any content that is false, misleading, illegal, harmful, or infringing upon the rights of others.

Eventnoire reserves the right to remove content that violates these Terms or is deemed inappropriate.

Communications  and Notifications

By creating an account, registering for or attending an event, or otherwise engaging with Eventnoire’s services, you consent to receive communications from Eventnoire, including:

  • Administrative messages (e.g., account updates, changes to the Terms of Service);

  • Marketing and promotional messages (e.g., event recommendations, newsletters, special offers);

  • Transactional and event-related notifications (e.g., ticket confirmations, reminders, updates).

You may opt-out of marketing communications at any time. Please note that even if you opt out of marketing messages, you will still receive essential administrative and transactional notifications necessary to maintain your account and support your participation in events.

Privacy

Your use of Eventnoire is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data. By using the Platform, you consent to the collection and use of your information as described therein.

Refunds & Event Cancellations

Refund policies are determined by individual Organizers. Eventnoire does not issue refunds unless required by law. All refund-related inquiries should be directed to the Organizer of the event.

Third-Party Services

Our Platform may integrate or rely on third-party services (e.g., Stripe for payments). We are not responsible for any disruptions or damages caused by third-party service providers.

Arbitration & Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform will be resolved through binding arbitration, rather than in court, except for small claims. You also agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

  • The arbitration will be conducted by the American Arbitration Association (AAA).
  • The laws of the State of Delaware will govern these Terms, without regard to its conflict of law principles.
  • You may opt out of this arbitration clause within 30 days of first accepting these Terms by sending a written notice to: support@eventnoire.com

Limitation of Liability

To the fullest extent permitted by law, Eventnoire is not liable for any damages, losses, or injuries resulting from:

  • Attending or participating in events
  • Using or being unable to use the Platform
  • Errors or inaccuracies in content or transactions

Total liability in all cases is limited to the amount you paid us, if any, in the 12 months prior to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Eventnoire and its officers, directors, employees, and partners from any claims, damages, obligations, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of third-party rights.

Miscellaneous

  • Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and Eventnoire.
  • Severability: If any provision is deemed invalid, the rest of the Terms will remain in full force.
  • Waiver: Our failure to enforce a right or provision does not waive our right to enforce it later.
  • Assignment: You may not assign your rights or obligations under these Terms without prior written consent.
